  • Analyze the evidence: Was there adequate evidence to charge the juvenile with a DUI? What was the evidence? Is the evidence circumstantial?   • Challenge the stop: Did the officer have probable cause to stop the car? Did your child fail a field sobriety test? In addition, field sobriety tests are unreliable if they are not conducted according to DMV standards.
  • Examine breathalyzer testing: When was the breathalyzer performed? Did the operator have the proper license? Breathalyzer readings are very useful to a prosecution's case, but they cannot be admitted in court if the breathalyzer test was not properly administered or the operator did not have the proper license.
